Code of Conduct: tourist services

(LEY 1336 DE 2009) this Act shall be adopted and enforced by all providers of tourist services

In compliance with the provisions of Article 1 of Law 1336 of 2009, the Ministry of Commerce, Industry and Tourism has developed a model Code of Conduct, which according to the provisions of this Act shall be adopted and enforced by all providers of tourist services. The commitments enshrined in the Code of Conduct were presented to representatives of the industry associations who made contributions and recommendations in advance meeting on 21 October 2009 at the premises of the Ministry of Commerce, Industry and Tourism. Attending the input received at this meeting the minimum commitments that should contain the Code of Conduct to be taken and meet tourism service providers as follows were drafted:

  1. Refrain from offering programs in tourism promotion and tourism plans, express or surreptitious plans sexual exploitation of children and adolescents.

  2. Refrain from giving information to tourists, directly or through an intermediary about places where coordinated or practice where commercial sexual exploitation of children and adolescents.

  3. Refrain from driving to tourists, directly or through third parties to establishments or places where commercial sexual exploitation of children is practiced, and lead them to places where they are staying tourists, even if it is places located at sea, for commercial sexual exploitation of children and adolescents.

  4. Refrain from providing tourist routes vehicles for exploitation or sexual abuse of children and adolescents.

  5. Prevent the entry of children and adolescents hotels or places of accommodation and lodging, bars, similar businesses and other establishments where tourism services are rendered for exploitation or sexual abuse.

  6. Take measures to prevent personnel involved in any capacity with the company, offer tourist services that enable sexual activity with children and adolescents.

  7. Protect children and foreigners from all forms of sexual exploitation and domestic violence caused by foreign tourists or national or adolescents.

  8. Report to the Ministry of Commerce, Industry and Tourism and other competent authorities, the facts that he was aware by any means, and suspicion of these related to sexual exploitation of children and adolescents and ensure that within company channels exist to denounce to the competent authorities such facts.

  9. Design and disseminate within the company and with suppliers of goods and services, a policy in which the provider establish measures to prevent and counter all forms of sexual exploitation of children and adolescents in travel and tourism.

  10. Train all personnel involved and go linking the company and the suppliers who by the nature of their activities have contacts with tourists, address the issue of prevention of commercial sexual exploitation of children, children and adolescents.

  11. Informing users about the legal consequences in Colombia of exploitation and sexual abuse of children and adolescents.

  12. Fix in public and visible of the establishment or commercial establishments this Code of Conduct and other commitments that the provider wishes to assume in order to protect children and adolescents place.
